BRBito Terms of Service

These Terms of Service govern your use of the BRBito mobile application and related services.

By downloading, accessing, or using BRBito, you agree to these Terms. If you do not agree, do not use BRBito.

1. BRBito’s purpose

BRBito is a general wellness app that helps you plan and complete short breaks during periods of focused or sedentary work.

BRBito does not provide medical advice, diagnosis, treatment, therapy, emergency services, occupational-health advice, or a guarantee of health, wellbeing, productivity, fitness, or other results. It is not a substitute for professional medical advice.

You are responsible for deciding whether a suggested break or activity is suitable for you and your environment. Stop any activity that causes pain, discomfort, dizziness, or concern, and seek qualified advice where appropriate.

2. Eligibility

You must be old enough to enter into a binding agreement where you live. If you are under the age of majority, you may use BRBito only with the involvement and permission of a parent or legal guardian, to the extent permitted by law.

3. License

Subject to these Terms, BerylCode grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use BRBito for lawful, non-commercial purposes.

BRBito is licensed, not sold. BerylCode and its licensors retain all rights in BRBito, including its software, content, artwork, branding, animations, text, sounds, and other intellectual property.

BRBito stores certain preferences, reminder settings, and break-session information locally on your device. You are responsible for maintaining access to your device and for any loss of locally stored data caused by deleting the app, clearing app data, changing devices, device failure, or an unavailable backup.

6. Notifications

BRBito may request permission to deliver local reminders. Notifications are optional and can be managed through your device settings. Delivery depends on your device, operating system, notification settings, battery-management settings, and other factors outside our control. BRBito does not guarantee that a notification will be delivered at a particular time.

7. In-app purchases

BRBito offers the Halloween Pack as a one-time in-app purchase. It is not a subscription. The price and included content are shown before you confirm a purchase.

Purchases are processed by Apple App Store or Google Play and managed in the app through RevenueCat. Payment, cancellation, and refund terms of the applicable store, and any mandatory consumer protections, apply. You can use Restore purchases in BRBito to check eligible purchases and regain access.

8. Updates and availability

We may update, modify, suspend, or discontinue all or part of BRBito. We will use reasonable efforts to avoid material disruption where practical, but we do not guarantee that every feature will always be available, uninterrupted, or compatible with every device or operating-system version.

You are responsible for installing available updates. Some features may not work properly without current software.

9. Feedback

If you provide ideas, suggestions, or feedback about BRBito, you grant BerylCode a worldwide, perpetual, irrevocable, royalty-free right to use that feedback without restriction or compensation to you.

10. Disclaimer of warranties

To the maximum extent permitted by law, BRBito is provided “as is” and “as available.” We do not warrant that BRBito will be uninterrupted, error-free, secure, available at a particular time, or suitable for your particular purpose.

Nothing in these Terms limits any warranty or consumer protection that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by law, BerylCode and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from or related to BRBito.

Where liability cannot lawfully be excluded, BerylCode’s total liability for claims arising from or related to BRBito will be limited to the greater of: (a) the amount you paid to BerylCode for BRBito in the 12 months before the event giving rise to the claim; or (b) the minimum amount required by applicable law.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where exclusion is prohibited.

12. Termination

You may stop using BRBito at any time by deleting it from your device. We may suspend or terminate access if we reasonably believe you have violated these Terms, applicable law, or the rights or safety of others.

Sections that by their nature should survive termination will survive, including intellectual-property, disclaimer, limitation-of-liability, indemnity, and dispute provisions.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, excluding conflict-of-law rules. Courts located in Sheridan County, Wyoming, United States will have exclusive jurisdiction over disputes, except where applicable consumer law gives you the right to bring a claim elsewhere.

If you live in a jurisdiction with mandatory consumer protections, nothing in these Terms limits those protections.

14. Changes to these Terms

We may update these Terms when BRBito, our business, or applicable law changes. We will post updated Terms in the app, on our website, or through another reasonable method. Your continued use after the effective date means you accept the updated Terms where permitted by law.
